Re: VSS (Voluntarily Separation Scheme)

Hi Sir,

1) May I know VSS is covered under which statutory provision Act? is it the employment regulation 1980? if yes, where can I find the act?
2) who are eligible for VSS? and under what condition that VSS can be used?
3) What if employer offer vss to staff and staff reject?
4) how is the calculation and payment for the VSS?

Please revert soonest possible.

1. It is not, it is a scheme offered by a company in the event of restructuring or downsizing
2. It is up to the company to decide what type of workers or section or department to be offered. However, the company should be very careful in formulating such a scheme and expert advice should be sought.
3. Staff can always reject in the scheme is not attractive.
4. I don't know if there is a formula but come company may use the Employment(Termination and Layoff Benefits) Regulations as a general guide.

Hi Sir,

Is the following the formula for the Employment (Termination and Layoff Benefits) Regulations?
6. (1) Subject to the provisions of these Regulations, the amount of termination or lay-off benefits payment to which an employee is entitled in any case shall not be less than -

(a) ten daysí wages for every year of employment under a continuous contract of service with the employer if he has been employed by that employer for a period of less than two years; or

(b) fifteen daysí wages for every year of employment under a continuous contract of serviced with the employer if he has been employed by that employer for two years or more but less than five years; or

(c) twenty daysí wages for every year of employment under a continuous contract of service with the employer if he has been employed by that employer for five year or more,

and pro-rata as respect an incomplete year, calculated to the nearest month.

Please advice.

The situation goes like this:
1.Selected employees were informed by HR of the vss package1 verbally.
2.Employee applied(hand written letter) to the scheme
3.Reply by HR to notify on the status either successful or rejected.
4.Selected employees have not receive any printed detail package2 after 8 days upon received of the reply.
Q&A:
1.Is this a normal practice?That means the employee applied to the scheme without any vss reference package except the Quantum Offered.
2.Package1 verbally being informed include manager position allowance and pro-rate yearly bonus but package2 verbally being informed without manager position allowance and bonus. Is this consider "deceiving"?
3.Any reference vss procedure available?
