O/T MORE THAN 9HRS.

QUESTION:
HOW MANY HRS CAN BE WORK AFTER WORKING HRS?
CONTRACT WORK OR PERMANENT WORK ONLY ?

1. The law says not more than 12 hours per day unless there is an emergency. Read Part XII - Hours of work

2. Applies to all workers covered by the Employment Act.

A person's normal hours of work is 9hrs incl of lunch break. To calculate his overtime rate at 1.5% of his daily wages - should the hourly rate be derived by dividing the daily wages by 8 or 9 hrs (incl of lunch break)

For OT formula is (salary/26x8) x 1.5

Scenario 1: Workers complete 40 hours in a week (5 days of 8 hours work). During the week, he also completed 10 hours of OT. His overtime calculation would be:

10 hours 8 hours = 2 hours.

(The minus 8 hours is to make up the shortage of normal hours of work of 48 hours in the week).

Will it be alright to do so?

I would like to know.if a hr/payroll management trainee earning rm1600.work 5 days a week, work from 9am till 6pm.Can he claim ot or refuse to do ot?what is the maximum ot he can to do per day?Can the management ask him to take work back and do on off and rest day?
