Hi, the company that I work for claims that should we take more than 2 MCs in a month, they would then deduct our salaries. Is this possible? My HR claims it is so. (We are all still under probation)

As i know there is no such rule in EA. In the EA, the MC is count per year. There is no rules say every month can take how many days.

BUT

If you are not cover with EA then it is possible, whereby the employee is bond by the offer letter.

In our LOA, there is no such thing stated. It only states that we are entitled to 14 days Medical Leave. Our salaries are all RM2500 and above.

Since it stated 14 days Medical leave mean every year you are entitled up to 14 days MC. So what your hr department do is wrong or maybe he/she trying to reduce staff MC or discourage them to take MC.

So can I lodge a report against them or are their actions justifiable since they are trying to reduce/discourage staff from taking MCs? We have tried reasoning with them but to no avail. My HR insists that MCs are pro-rated as ALs.

Lodge a report not a good idea if you still want remain in the company.

If your hr say it is pro rate then just pro rate. Just don't take MC too much on Jan and Feb. After that you can take more than 2 days start from March.
