Re: Calculation of damages for constructive dissmissal staff.

One of my staff who alledges that he has been dismissed constructively, has initiated an industrial court action against my company. The hearing has been concluded and we are now awaiting the judgement by the Industrial Court. During the hearing the said staff admitted that he has found a new job with another company dealing in a similar trade as mine about 2 months after he left my employment with a bigger salary. If the court found that my company was guilty, would the staff's earning with the new company be taken into consideration in calculating the damages due to him?
