Hi.

refering to the Anuual leave, my company policy is AL is 8days for over 1 year service but less than 2 years.

i Join in date 03.05.2010, can i enjoy the full 8 days of AL starting from 03.05.2011?

Please advised.

However my HrR say to me the following
"Annual Leave yes, you are entitled, pro-rata, till Dec 2011 4.5 days starting June 2011. "

Under section 60E(1), If an employee terminates his service of less than one year, he is entitled to annual leave in direct proportion to the number of completed months of service in that year.

By above statement, you can see clearly the AL is count from the day you join. After 1 year completion, you can straight take the 8 days, If not yet complete 1 year, you still entitled to it but just can't take it unless you resign then the HR will count the pro rate AL for you.

Many HR try to fool employee and reduce their benefit because, their KPI is depend on how well they maintain the staff with the MINIMUM BENEFIT/COST.

so the conclusion is what if they not allowed me to take any AL for the year which i am compledted?

in simple
join date 03.05.2011 - 03.05.2011 - 8days (still have not taken any)
now is past 03.05.2011 - consider a new cycle of year - should be entilted for another 8 days to 03.05.2012? is that correct calculation?

this type of issue should i go to the labour office, what would your best advised be?

For 03-05-2010 to 03-05-2011 (1 year) consider 8 days

04-05-2011 to 31-12-2011 (Pro rate calculate AL)

01-01-2012 to 02-05-2012 (Pro rate calculate AL)

03-05-2012 to 31-12-2012 (Pro rate calculate AL but different AL - 2 year)
