Re: Staff resign with 24 hour notice

At end of month (after receiving salary), employee tendered a letter of resignation with 24 hour notice but in contract it is stated that 1 month notice is needed otherwise pay 1 month's salary.

We want to ask the employee to return the 1 month's salary, but can we also ask her to pay back employer EPF & SOCSO contribution for that month?

Nope, You can't do that.
The 1 month salary is mean the gross salary of that month.
The EPF and SOCSO that the employer contribute is last month. For this month, employer no need to contribute to her since she already resign.

I have been working in this company for 10 months. There is no appointment letter. During this period I had been given, leave, an increment and bonus.

I want to leave the company by giving 24 hours notice. Under the law can I do it?
