I am a HR Assistant Manager that does not have any authority to payroll or salary matter. However, I do attend to staff complaint. Our company employs external contract workers and company contract workers. Our company contract workers are with EPF & Socso. But the external contract workers outsourced are not. Are they not entitled to these benefits? They were sometimes not paying in full but I was not there to ask, as Finance pays to the contractor and the contractor pays to them. They 'screamed' for my help. What can I do?

Your company contract workers is entitled to EPF, Socso and other benefit your company have.

For outsourcing, It is the outsourcing company pay the worker. Your company will pay a professional fee to the outsourcing company. So any benefit they want, they need to discuss with the outsourcing company (their real employer).

What you can do is call them go to the outsourcing company HR department.

There is no HR department on their outsourcing enterprise, just a boss and a clerk (I guess). The scenario is, they have no where to go for the complaint and they are illiteral working mothers in their 40's. No EPF, no socso, no medical compensation, no holiday to be counted, paid by hourly, no work no pay, work OT but miscount for payment or no payment. They want to quit and be our company contracts but the PIC manager of our company prevents that as the outsourcing enterprise belongs to his relative's. Many just quit for good although they loved working with my company.

Normally if a company don't have HR department, then it will go directly to the BOSS.

The worker can consult to labour department since the company no contribute the EPF, SOCSO and provide normal benefit to staff.

Can I go with them to be their aid/translator to file the complaint? Where can we go? Recently, one of the workers admitted to hospital for a surgery. Can she claim Socso?

You can go to:-

and look for the labour department address for your stated. There is nothing wrong if you go with them.since you want to help them out.

For staff that admit to hospital, if he/she is injured during working hour or 30min coming to work or back work. He/she can claim socso.

Sorry for late reply, i forgot to ask you to be careful a bit on the matter.

Since the outsourcing enterprise is belongs to "his" relative's, so it may cause office politic in the future.

Thank you for your advice. I have been warned by his subordinators regarding the matter as he takes the authority onto his hand. Even without the notice of our Managing Director.
