Re: Company Guard

Our company guard was required to work 12 hours per day (8am-8pm), from Mon to Sat. However Sunday and Public Holiday is Off day. Wages paid to him as follow:

8am to 4pm : normal hourly rate of pay

4pm to 8pm : 1.5 x hourly rate of pay

He was not entitile to a formal lunch break hour as other staffs and he is not allow to leave the company for lunch but allow to taking the meal in the company.

According to labor law, a rest period should be given to staffs for not more than five consecutive hours. Base on above case, do we againts the law?

If you continue to read the proviso of that section of the EA, you will find the guidance there. Your practice is OK.
