Re: Retrenchment or Compensation

My company give 2 month terminate letter to me (salary more than RM1500, working more than 10 year in same company), Should my company suppose to give me any retrenchment or compensation under Labour Law ?

KKK, you better approach the Industrial Relations Department for advice. Do it within 60 days from date of termination.

But the Industrial Relations Department say that the abovemention case not related to they department and they asking me refer Labour Law ? so whice department should i suppose to compaint ?

You can only claim for reinstatement under Section 20 of the IR Act, to get back your job. Don't ask for compensation there.

Thank you for your answer. The Labour Law Act was setting at 1980 for protected salary below RM 1,500 and salary above RM 1,500 is salary executive so not under protected by this Law. Now is year 2011, Our Prime Minister also said salary below RM 3,000 listed as lower income and minimum salary will be set at future and every year the pencentage increasing of inflation, how come the salary above RM 1,500 is executive salary and still under not protected. At my opinion, as a lower income Resident i hope the income benefit addendum coverage for Labour Law Act should be change for more worker can get this protected.

The trouble is the Employment Act 1955 has not yet been amended. You can always go to the Labour Department and discuss the issues with them and get a better understanding of the law.
