Re: Employee medical report


1. Can employer obtain the medical report of an employee from the clinic without getting the approval of the individual? if no, which article in Malaysia Law mention that?

2. and if let say the management feels that the employee have some disease which will affect the operation of the company, (F&B line), after we reqeust for the medical report, can he/she refuse to show his/her medical report?

Please advise.

If the employee was sent for medical examination by the company as required under the company's rules, I think the doctor will normally submit a report to the company. If he was not sent by the company, the doctor may not want to disclose his medical conditions.
