Re: Termination without Compensation

Thank you in advance for your advise.
I am a mgr with salary more than RM 3K / mth and if my company want to terminate me, am I entitle to termination compensation as stated in Employment (Termination and Layoff) Regulation?
My contract mentioned both parties can give 1 month notice to either party to terminate contract.
Is this mean that my company can just give me 1 month notice to me to terminate my contract without any compensation?

Employment (Termination and Layoff) Regulations is not applicable to you. Yes, either party can terminate the service with a month's notice. However, if they terminated your service without goods reasons or without adequate compensation, you still can complain to the Industrial Relations Department and ask to be reinstated.

Dear Mr Siew.

Thank you for your reply. I have a few questions to ask you.

1) Do company had to give reason for the termination of my contract?
According to the contract, either party can terminate contract with 1 month notice without having to explained reasons.

3) Is it reasonable for company to terminate my contract if I refused to accept new assignment? The company hire new manager to take over my job and assign me to new section.

3) Do you know what is considered as adequate compensation I should ask from my company? I worked for 15 years.

You would prefer you consult the IR Department with an open mind. Pay them a visit personally.
