Dear sir,

I would like to get some verification on the labour law in Malaysia.

In the Malaysia Labour Law, is there any clauses stated that staffs canít take half day Annual Leave or Emergency Leave?

In the Employment Letter stated working days is Mon Ė Friday, Saturday is alternate. On October 2010 got 5 weeks, pls advise how many Saturday need to work.

If it is off day on alternate Saturdays, then obviously you work on one Saturday and off on another Saturday.

Is that meant i need to work 3 saturday? What about this month?

For the AL & EL can't take half day, must be 1 full day, is this clause really exist?

If that Saturday is not a off day decided by the company, then it is just another ordinary working day.

Some companies treats it as half day while some as full day. If your company treats it as half day, then you can avoid taking leave on Saturdays.

The half day leave that i referring is not on Saturday... is on week days. Pls advise.

Pls advise what should we as staffs in the company, if the clause (no half day AL or EM) was not approve / raise up by the management of the company (or the owner of the company). It was fixed by the HR.

Please also brief me, whatís the actual rules that as a Personal Assistant cum HR Executive in a company, can he/she fix any rules / clauses in the company without getting approval from management? If management approved, the HR suppose come out a memo on the notice board or via email, not by verbal right?

HR has all right to do all that. If the staff are not happy about something, they can always bring the matter with them or during staff meeting, if there is any.

Dear sir,

I would like to get some verification on the labour law in Malaysia.

In the Malaysia Labour Law, if public holiday was a Saturday (a) it was rest day for 5 .5 days employee and (b) day off -in lieu for 5 day employee .

If Annual leave on Saturday are treated full day, the day off-in-lieu is full day and (b) if annual leave Saturdays are reated half days , the off in lieu is half day.

Can company deduct staff salary if the emergency leave taken by staff was not with valid reason and not supported by any document? That particular staff regularly takes emergency leave as the staff said emergency leave is his entitlement, should be deducted from annual leave entitlement. Staff adamantly did not allow company to deduct his salary and mentioned that he will bring case to Industrial Court if his salary being deducted. Can he do that?
