My employer did not state retirement age in my offer later and the "permanent staff handbook".

My question is, What is the retirement age for private sector under Malaysian Law?

There is not retirement age under the Employment Act.

In this case, can an employer compel an employee to retire when that employee reaches a certain age, when the employee refuse to accept terms of the early retirement, even if the offer for compensation is higher than market norm? In the event that this goes to court, how is the court likely to decide? Since the retirement age is not stipulated, what would be the basis that the court can use to award compensation to the employee? In jurisdictions with fixed retirement age, eg 65 years, it would be logical to assume that the court will award compensation based on the number of years left to retirement, but since retirement age is not stipulated in contract nor law, it is hard to anticipate the likely outcome.
