Re: Exchange annual leave to 'Cash'

At the end of year, an employee still remain 4 days annual leave.
According to company policy, it can not be bring forward to next year. Therefore he would like 'exchange' his annual leave as cash/salary. in other words, he does not want to take annual leave.

is it legal in malaysian labour law?

In the employment act :
"The employer SHALL GRANT and the employee SHALL TAKE such leave".
"Employee who fails to take such leave.... shall thereupon cease to be entitled thereto:
at the request of his employer not to avail himself any of his annual leave entitlement.
