Re: OT for Bank Execs

Hi, I would just like to know if is stated in the Labour Law that an exec is not required to perform OT. I am a customer service executive working in a call centre in a bank here in KL. We operate 24 hours and work in shift, 9 hours a day with an hour break. Lately the call volume was so high that the management had decided to activate OT (extra 2 hours). This means that we need to answer calls for 10 hours. This started since June 2009, we were convincde by the management that the arrangement is temporary, as it business needs. We are paid RM30 for the extra 2 hours. The management seems to take advantage of us and kept activating OT everyday consecutively. To put it in a simple word we were force to do it. Those who declined need to come up with an explaination and need to replace it. We were also inform that we need to face the higher management and warning letters will be issued. I came to know that as an exec we are not required to perform OT and it is stated in the labour law. Can someone please advise if this true?

You are not among one of the Bank's Employees Union members?

Sha,
For sure there's a "Collective Agreement" (CA) between the Union and the Bank. As an Exec you should know better.

I am direct employ under the bank. I'm not of aware of any CA, guess i don't know better. I'll chk it out. HR said that execs are not required to do OT. But in our case it is due to business needs thus the management can activate OT, it's their call. What I'm not happy about is the idea of forcing and threatening us

The main problem now is "You don't know "where you are!" .
