Re: Negative payment

Dear Siew,

Once of my staff rejoined us as a part time employee on 24 August 2010. Based on her first employment with us, she was a full time staff and owing the Company the notice in lieu on June about thousand plus. When she rejoined on 24 August 2010, we verbally talked to her that we are going to deduct the negative payment from her current salary which is not more than 50% from her salary. She dissatisfied and resigned again. Her balance of current salary is hundred plus only. Is the law allow us to deduct all her current salary since she resigned already?

Need some clarifications before I comment, if you don't mind:

(a) When she came to work part time on 24 Aug, did you inform or remind her that she still owed thousand plus as indemnity and that you would deduct from her salary? or

(b) You did not mention anything about the indemnity or deduction but when pay day came, you told her an amount would be deducted and was deducted from her salary. She got angry and resigned.

From (a) and (b) which is more accurate? If neither what is the true version?

Just hold on the money. I don't know whether she will complain to the Labour Office or not.
