hi, currently i work in a retail shop as an assistant manager. this retail shop open 365 day, so that mean i also require to work when in holiday. but the company dint pay me double wage instead exchange to me 2 extra day off. are that legal??

If your salary is more than Rm1500, you are not covered by the Employment Act. If that is the case, double pay for working on holidays as mentioned there is not applicable to you and I think getting two extra days off is quite a good deal. If you want to be paid instead, you can always talk to the management.

so that mean i not cover by the employment act 1955 and i will not receive any benefit from it like annual leave, sick, rest day, and other??
then the my company can set it welfare to it employee without following any law??
am i correct??

When you have knowledge of the EA and the benefits stated therein, you should be able to negotiate with your employer for terms and conditions at least at par if not more than those benefits. When those employees in your company who are drawing salary less than RM1500, are enjoying those benefits in the EA, those higher grade employees like managers should be able to ask for at least the same if not more. If they don't negotiate properly or dare not negotiate, it is quite possible to end up with a raw deal.
