Re: Termination of Probation staff

I have a staff who was on 6 months probation from 1-Oct-08 till 31-Mac-2009. His probation was extended further 3 months from 1-Apr till 30-June-2009. during this period, he got 1st, 2nd & Final Warning letters for being absent without informing his superior. We given him chances to explain his absent in writing and his reasons varies from being sick and too weak to make a call, diarrhea to woke up late. We have even prepared a confirmation letter to confirm him on 1-July but he still didn't sign it yet. For this case, can we terminate his service? he was absent again today 14/July. Kindly advise.

You have already issued him a confirmation letter, but he hasn't signed it. You have the rights to sake him provided he fails to produce the medical certificates to support his health comdition which caused those absences.

Thanks CK for your prompt reply! So if according to labour law, i can terminate his service by giving him 7 days in writing or pay in lieu of notice(which is stated in appoint. letter). am i rite?

It depends on the "notice for termination" stated in the appointment letter. For the non-senior positions, it is common to see a 24 hour notice in many companies... as long as he/she is still under probation. But for your case, you have to give him a 7 day notice in writing as stated in the appointment letter or pay in lieu.
