i joined in this company on 16/9/2006 until now.
my question is:
1) is it the employee must give 4 weeks notice if have been emplyed less than 2 yrs, 6 weeks for more than 2 yrs but less than 5 yrs, and 8 weeks for more than 5 yrs for resignation.
2) on qeustion no.1 if yes, but my company is no have appoinment letter for staff, how should i do?
3) my staff have 1 day of unpaid leave, how to calculate his allowance on this? Basic - 4500, Car Allowance - 300, Phone Allowance - 150. is it i must pay full on his allowance?

With a salary of 4.5K, he is not covered by the Employment Act. So, the 4, 6 or 8 weeks notice do not apply in his case.

I understand fr the few queries online, so what is the level of salary convered by the Employment Act? If employees salary are above the level the covered by Employment Act, where/who should they approach for any discrepacies/wrong treatment during their employment with their employers? If not covered by the Employement Act, how many days is the approved Annual/Sick/Study leave? And where can I obtain the Employment Act book?

my company here no have appointment letter and confirm letter, how long should i give the notice to resign? My salary is rm1700.00 per month. anual leave is 12 days per year, and sick leave is 18 days pery year. my working hour is 8.30am to 5.30pm.

To LSK, the Employment Act can be found on this website. Go to the home page and look for it.

To Zoey: The Employment Act covers employees whose salary is not more than RM1500. Since there is nothing mentioned about notice period in the contract of service, one month's notice is sufficient. If you want to make sure, you can consult the Labour Department.

i have a question tat i have a staff who send a resignation letter on 30june 09, and she wan to leave on 15 july. My company should give one month notice. so wat should i do?
