Re: working during maternity leave

during confinement period, my boss wants me to work from home. i have explained to him that i need my rest but he still insist me to work from home and do the payroll at the end of each month. pls advice.

I don't know how is your working relations with your boss and the workload involved. If you really cannot cope with the work, tell him so or get a letter from your doctor to say so. On the other hand, if the workload is not much and your boss really has no one to turn to, help out in whatever way you can. Anyway, you know the situation better

I'm responsible in the HR dept. The payroll, EPF, SOCSO & LHDN only me in the office are responsible for all. I will be on maternity leave in few months times and I have expressed to my boss that I won't be able to help out and he needs to find someone else to do it while i'm on leave. He still insisted me doing it and suggested for me to bring home the laptop and printer (I told him that i do not have a printer at home to print the hard copies as I do not have internet access). Is it legal for him to ask me to work during the leave? Is there any clause in the labour law that I can refer to?

Labour law or no labour law, you have the right not to work during your maternity leave. Under the EA, there is no provision whereby employers can require employees to work during maternity leave unlike for working on holidays and rest days. Since there are still a few months to go before your confinement, you can handover or train up someone for the job.
