Hi, i have one case on hand:
this operator work in our factory for 4 months then happen accident in Dec 2008 which is public holiday. From the doctor comment medical report is permanent disablement - unable to work due to head injury, cannot recover anymore. We give 60 days hospitalisation and this few months all UPL. Socso cannot claim because that day is PH. If claim under Socso- invalidity pension scheme also cannot because this guy only contribute 4 months Socso. Is it under labor law, this worker work for 4 months, company need to give any prolonged illness leave? Please advise, thank you.

Since he cannot work anymore, there is nothing much you can do about it. As the company has put him on NPL and is not going to do anything to help him out, why not just let the case rest ?

Hi, yes, now we would like to have a proper way to terminate him due to he cannot work anymore. But just to check that under labour law, prolonged illness it it entitled for him? Please advise, thank you.

There is nothing in the Employment Act about that. I don't know what sort of problems you are having with him. For me, I wont do anything to terminate his service. He cannot work, that is his problem. The ball is on his side. If you really wanted to, you may consult SOCSO how to have him medically boarded out in view of his prolonged illness.
