Re: Notice of resignation

I'm currently a teacher in one of the private schools in Selangor and i'm planning to resign.According to my EA it states that when we are to resign we are suppose to comply with 2 conditions:

1.Three months written notice and
2.The last working day must fall on the last day of the 1st or 2nd school semester.

Where notice is not available,the party serving the termination shall pay to the other sum equivalent to the required notice.

Therefore,what happen was i send in my resignation to my employer by giving 3 and a half months of notice.However,my last working day falls on Oct 15 and its not end of a semester as end of a semester would be on Nov 20.My employer has requested me to pay the difference from Oct 15 to Nov 20.I would like to know my right as a employer here.Can my employer ask me to pay the difference inspite of me giving 3 and half months notice eventhough my last working day is not end of a semester.

Please advice.

If you ask me, I would say you follow what is stated in the contract, don't care how long the notice you give. Someone has to teach until the end of the semester, isn't it?

There have been some cases whereby teachers have resign during the middle of semester by just giving 3 months notice and my employer did not ask them to pay.Isn't my employer being bias? Can i sue my employer for being bias whereby some ppl can resign during a semester but by just giving 3 mths notice.

Please advise.
