Hi, my company decided to pay us 2008 bonus this month, but i realize our boss not paying EFP employer 12% but deduct from my bonus. For example, bonus $1,000, EPF employee $110, EPF employer $120, my net income should be $890, but now he only pay me $770 (i ignore the socso and tax).

Can he do that, use our bonus to pay for the employer portion?

Please advice.

I suppose all of you should get together and talk to your management. Has this been the practice in the past?

This is not the practice in the past .

I heard that the mgmt can do this if pay for the bonus. But if they do that, the impact to us is we will need to pay extra tax.

So do they legal to do that?

It looks like management could do that if they wanted to put it that way. Just treat it as forced saving. You may consult the Labour Department if you wish.
