Re: Working Days & Hours

Hi all,

would like to inquire that on the Working Days and Hours

Example :
Monday to Saturday - 9.00am to 5.30pm
Sunday - OFF

Refer to the example above, the employee has been work more then 40 per week without any OT claim or replacement off.

is there any action can been taken to the employer ?

You are entitled to OT if you work more than 48 per week (not 40 hours). Lunch break is excluded. See Section 60A of the Employment Act below:

"60A. Hours of work.

(1) Except as hereinafter provided, an employee shall not be required under his contract of service to work:

(a) more than five consecutive hours without a period of leisure of not less than thirty minutes duration;

(b) more than eight hours in one day;

(c ) in excess of a spread over period of ten hours in one day;

(d) more than forty-eight hours in one week:....."

thanks for your feedback.

another question is :

In my department, I and my team is only require to work 6 days per week without any claim or replacement off given, and the others is only work 5 days per week.

Is it consider not fair for me and my staff?
