Re: Not yet an employee but want to sue the company

Can a person who just joined a company but he refused to do work sue the company after he was instructed to stop work immediately? This person went to the Labour Dept and the Labour Dept officer said the company cannot verbally terminate this person without notice. The company has not issued any offer or employment letter to him yet and he just worked for 5 days only.

How could the company allow someone to work for 5 days without issuing an employment letter to that person??

As soon as he reported for work, he was your employee. It does not matter he was issued with an appointment letter or not. He has the right to lodge a claim against your company.
