I would like to know is there any regulation on when an employee should obtain a sick leave on the day he is supposed to work ?
For example, working hours is 7.30am to 5.30pm. Should he see a doctor and get the sick leave before 12 noon ? Is TIME a factor when it comes to approval by an employer ? Can supervisor reject the sick leave if it is claimed only in the afternoon ?

There is no ruling as to when a worker should see a doctor, he may see a doctor as and when he falls sick. Should a worker find that rules set by the employer to be unreasonable, he could always refer the matter to the Labour Department.

1. Can a staff claim for sick leave from a non-panel clinic from the company?

2. Can a sick-leave from a non-panel clinic treated as an unpaid leave by the company?

1. Employer may not recognize sick leave by non panel doctor unless sick leave given under (b) of Section 60F below.

2. If sick leave not recognized, will be treated as no pay leave.

"60F. Sick leave.

(1) An employee shall, after examination at the expense of the employer:

(a) by a registered medical practitioner duly appointed by the employer; or

(b) if no such medical practitioner is appointed or, if having regard to the nature or circumstances of the illness, the services of the medical practitioner so appointed are not obtainable within a reasonable time or distance, by any other registered medical practitioner or by a medical officer;

be entitled to paid sick leave..."

If a staff gets a MC for 1 week, does the MC inclusive of saturday & sunday?

I need your advise in a case whereby a staff taking MC (Paid sick Leave).

Normal Working Hour : 7.30am-3.30pm

She works from 7.30am-9.30am with the reason not feeling well, she went to see a doctor after 9.30am and doctor provide her MC for that day. But suddenly she wants to claim for the 2 hours work 7.30am-9.30am?

How can we solve this? As from what I know, staff have entitlement for 10days paid sick leave. Do we need to pay extra 2 hours more?

Are daily paid staff entitled to sick leave? Doctor gives her MC for a day but she comes back to work for 2 hours.

How should we treat this case?
