I have a query which I hope your coulf give me some advise on what is my right and what I can do about it.
The issue concern me is, as you may know due to the bad economy in US and it has badly affect Malaysia Financial Instituion. I am a Team Sales Manager for a Foreign Bank and has been with them for more than 4 years. I have to admit that my pay was quite ok (but does not exceeds RM 5k). My main duty is to manage a sales team consist of 10 sales executive.
In my "Terms of Contract" indicates that I "Would have to assist in the recruitment process". Does that mean recruitment is my duty and should I fail to recruit, it will be my problem. No assistance are being extended by my company nor my direct manager.
My next issue is, as mention above managing a team of sales executive (10 headcount). Due to the economics situation, my company has freeze all recruitment. All in all, recruitment has been freeze since November 2008. Which mean more than half year I could not recruit any sales executive to replace those resigned of terminated by company. As such, the number of people reporting to me has been lesser and lesser due to natural attrition. I am now have less than 5 sales executive. But my sales target remains as if I have 10 sales executive.
My question is, when my company restric me from recruiting and I have lesser people work under me, is it legal for them to require me to deliver the sales figure of 10 sales exec?
My boss just issue me a couselling note and warning letter are due next month should i fail to deliver the figure in the month of May 2009.
