Re: Balance leaves calculation

I just work 5 days a week, and 1 month I work not more then 26 day. Let say If I applied for 1 days unpaid leave, and my monthly salary is RM1000 and I work for 22 days at April, then my total deduction salary will be as below:

(RM 1000/22 days) * 1 = RM 45.5 (total deduction of salary)

If I claim 1 day annual leave as cash at April, below is what is will get:

(RM 1000/26) * 1= RM38.5 (total cash I claim from company)

I see, you are working 5 day week. You may have a point there but there is a formula in Section 60I of the EA as follow:

(1A) Where an employee is employed on a monthly rate of pay, the ordinary rate of pay shall be calculated according to the following formula:

monthly rate of pay
------------------------
26

As such, I think you may consult the Labour Department for an official opinion whether it should be 22 or 26
