My company's ruling handbook and appointment letter stated that unconfirmed staff needs to give 1 month's notice of termination while confirmed staff needs to give 3 month's notice. It is mentioned that confirmation will be given upon satisfactory performance after 3 months. I have been working in this company for a year but my employer have not yet confirmed me (no verbal or written letter). If I want to resign, should I give 1 month's notice or 3 months notice? The administration officer said that according to Labour's Law, if company didn't confirm me, I will be automatically confirmed after a certain period of time. Is that true? But if I leave, I want to give 1 month notice and NOT 3 months cos' it is not fair that I consider myself not confirmed (cos I didn't receive any letter of me being confirmed by the company). I like to know my rights here as an employee. If I leave, I have to give 1 month or 3 months' notice?? Kindly advise...as i don't want to get sued by the company if I leave 1 month...

There is nothing in the Employment Act about confirmation. I think it is safer for you to consult the Labour Office whether it should be one month or 3 months notice in you case.

i am still not happy with the answer. I really need to know what is my right on this issue...any person face similar problem with me. i saw you gave a reply to someone on his resignation but his is a contract service. pls help...

The best I can do .is to invite to read a writeup about this matter of confirmation. You can get it at http://pesaraonline.net/probation.htm Despite that, it will still be safer for you to consult the Labour Department in case there are latest judgments on the subject of confirmation, which are not known to me.

I am in your situation. I been working more then 6 months in this company but have not received any confirmation letter although they had staff review and I was verbally confirmed. Besides I was not given pay rise even after serving 6 months. I have tendered my resignation and my boss told me that I have to give two months notice. I told her no and I insisted on one month. I have called the labour officer and they said that the letter is must. Besides now my boss gave me an acceptance of resignation letter and in the letter it is wriiten that I could not work in the same line for one year. I said i am not going to sign as advised by the Labour officer.
