Hi! i was admitted to hospital for 3 days due to high fever and the doctor suspected i'm on Denggi fever. After 3 days , the doctor gave 1 week MC so that i can rest at home before underwent on the next blood test. The MC was given from Sunday to next Sunday which is 8days, the question is the what is the MC days deduction? 8days or 5days ? shall it include the weekend/public holiday? Please advise.

It is 8 days. The following Section says, rest day shall not apply when on maternity leave, sick leave and so on.

59. Rest days.

(1) Every employee shall be allowed in each week a rest day of one whole day as may be determined from time to time by the employer, and where an employee is allowed more than one rest day in a week the last of the rest days shall be the rest day for the purposes of this Part:

Provided that this subsection shall not apply during the period in which the employee is on maternity leave as provided under section 37, or on sick leave as provided under section 60F, or during the period of temporary disablement under the Workmen's Compensation Act, 1952, or under the Employees Social Security Act, 1969.

However, public holidays are excluded.

Hi..
Im refering to above doubt regarding calculation for MC.
If our factory only operate for 5 days in a week, then how this MC should be calculated?
Please advice.
