Hi,

Can I check whether there is anything such as Compassionate Leave in the Employment Act. One of my employee's mother-in-law passed away recently and she was absent for 2 days. She applied for compassionate leave for her absence.

One point to add on to the above question
Does staff under probation entitled for the compassionate leave , if any?
Or does it only apply to confirmed permanent staff?

There is no provision under Employment Act for compassionate leave irrespective whether the employee is under probation or confirmed. It all depends on the policy of the company. If there is no such benefit provided by the company, she should take annual leave for the 2 days.

my friends husband pass away on 23/5/09. she can apply compasionate leave or not ? is this leave stated in employment act ?

Dear Mr.Siew,

After reading your comments for the compassionate leave...I would appreciate if you could guide me for the fact that an employee do not receive the benefit of compassionate leave especially when the company does not provide it.

I need supporting papers or documents as per our respected Malaysian Law to provide to my management that compassionate leave is entirely up to the company's discretion.
