Re: MY EMPLOYER ASKED ME TO RESIGN

I joined in this company in May 08 and employed for 7 months. Still not confirmed. Now my employee asked me to resign but only gave verbal notice instead of written notice ( as stated in my appointment letter as 1 month notice by both parties) on 23rd Dec and asked me to work until 31st Jan 09.
Question :
1. Can I refer my case to Industrial court without letter of termination from my employer as my salary is RM2K.

Verbal notice is acceptable. However, if you think the termination of service was done without some valid reasons, you may lodge a claim at the Industrial Relations Department for reinstatement. Consult the IR Department.

Dear sir thank you for response

The reason for my termination is my employer has started a joint venture company with a relation thus asked me to resign but did not cease operation in the current company.

1. Can I refer to IR dept without the termination letter?
2. Can I request termination letter from my employer?
3. If, my employer gives short notice does she/he have to pay in lieu of notice?

They asked you to resign or wanted to terminate your service, which is which?

Then, simple, don't resign. Let them terminate your service if they want to.

i was given 2 option by the employer verbally.

1. either i give in a resignation letter within 24hrs or

2. the employer will terminate me within 24 hrs.

i was reluctant to resign but i finally resigned under duress.
