Re: Staff seconded to subsidiary company

A staff in company A (holding company) was seconded to a new subsidiary company owned 100% by company A. The staff job scope n duties are entirely different from what he used to do in Company A.

1. Can company A transferred 100% the cost of salary of the staff to the subsidiary company?

2. Is the staff entitled to a transfer/seconded allowance from company A?

3. Is there any labor law act that I can refer to spesifically on this matter?

I am not aware of any law specifically on the matter. Company A, the subsidiary company and the staff involved should discuss all the terms and conditions fully and have written agreement drawn up before the transfer is carried out.
