I have an employee who recently join and on the second day tendered his resignation. We informed him that he need to serve 1.5 months or pay us the amount in lieu of notice at stated in the offer letter. He said that he will say on because he does not want to pay, however he has been playing truant of sorts by coming in late everyday, going on mc and also shirks his work or making lots of mistakes . I think it is his idea of punishing us for asking him to server the full notice.
If we decide to let him go are will liable to pay him the 1.5 months salary instead ?
