Hi,

I have an employee who recently join and on the second day tendered his resignation. We informed him that he need to serve 1.5 months or pay us the amount in lieu of notice at stated in the offer letter. He said that he will say on because he does not want to pay, however he has been playing truant of sorts by coming in late everyday, going on mc and also shirks his work or making lots of mistakes . I think it is his idea of punishing us for asking him to server the full notice.

If we decide to let him go are will liable to pay him the 1.5 months salary instead ?

Talk to him first ff you want to let him go and tell him to put in a letter of resignation resigning with immediate effect and pay him for the number of days worked. You cannot just tell him to go without that letter of resignation because he can turn around to say you have terminated his service without notice.

I have already talked to him and told him he can go and there is no need to pay anything to us but he doesn't want it now ... he still insists on saying on until the 1.5 months are over but his presence is creating a lot of problems for us.

If we give him termination are we liable for the 1.5 months now ?

If he has not committed any misconduct, you will have to pay indemnity for the 1.5 months.
