Hi, Good afternoon. Last time, I did ask you question about annual leave. I asked u if i have not complete 12 months service with the same company, whether I am entitled to annual leave in proportion to the months of service completed. You said that I am eligible to get the annual leave although it is stated in my confirmation letter that after one year of service only I am entitled to get annual leave.

I would like to know if my salary is more than RM 1500, whether I am still protected under the Law? Whether I still can complain to the labour office if my company refuse to give me annual leave.

Did I say that you were entitled to proportionate leave when you have not completed 12 months service? In actual fact, you are entitled only WHEN YOU RESIGN. YOU ARE NOT ENTITLED TO PRORATED LEAVE WHILE YOU ARE STILL WORKING AND YOU HAVE NOT COMPLETED 12 MONTHS SERVICE. Your company can refuse to give you prorated leave if you have not completed 12 months service.

Sorry, I forget to tell you that I had resigned. I just want to find out whether I am protected under the law if my salary is more than RM1500.

If it is annual leave, you may approach the Labour Office see whether they can help you.
