Re: Forced to resign following winding up

If we are forced to resign because the company wants to winding up, do we get benefits? Because its not us who want to resign but company is doing very well...just unsolvable internal disputes between shareholders. Issue is we get compensation or not?

How did they "force" you to resign? Never mind what internal problems they have, you just don't resign if they want you to resign. If you resign, you wont get any benefits under the law.

Force in the sense that we have to leave the company as the company will no longer be operating following voluntary winding up. are entitle to compensation

You can complain to the Labour Department once the company ceases operation and you are no longer provided with work.

But its not so much of issue of reporting to Labour Office but more towards the compensation or termination benefits that we are entitle to. What are the labour dept's min requirement to compensation us?

dear KL Siew,

im workin in a buildin management company. as our buildin acquisition has been long delayed since last june 2008, finally we got a letter in january declared our management service will extend to 2nd April 2009.

right now, all of us here in this company are feelin so lost of direction. and we gotto prepare for ourselves and i start searchin for job incase the new management will not hire us.

it's now mid March '09, my manager received a fake info of my resignation (not continuing my service before the handover - should our company service stil extend) fm 1 of my colleague who's her sister.

but i did not tell anybody that i want to resign, i did not officially announce, n most importantly is, i did not tender any resignation letter.

my problem now is, what should i do if my manager keeps assuming i am not continuin my service after 2nd april '09? what if after my explanation, she stil insist do not accept me continue in my present company? what if she accuse i have no more inspiration workin here as i once said to him wen he asked if i would continue extend my service before the handover - "i will continue if it's goin to be another 2-3 months. if 6 months, i might consider then"

do u think she has the right to stop me fm continuin my services? she is just my manager. if she has the authority, will i get compensation for sacking me?

plz advise. thank you!
