Dear KL Siew,

A staff had absent to work for more than 2 days and we considered him absconded. After deducted the salary in lieu of notice, he still have balance of annual leaves and overtime payment.. My question is , does he entitled to the balance of payment?

You don't bother to find out why he was absent? If he has no reasons for his absence, you may withhold everything as you may want to use them as payment for indemnity in lieu of notice since he has deemed to have broken the contract of service.

He worked another place already! So is it rightful to hold the balance of payment?
