Re: Termination and salary problem

My ex-company had faced the financial problem on December so they have announce the last day of work at company on 26 December 2008. They said they want to terminate 2 month but the company did not pay us the salary for December and EPF since OCtober until December while they had deduce our money for EPF. All of us (employee) decide dun want to wait the company for 2 month so we have decide to get the new job. We also have go to KWSP to sue the company about EPF on January 2009 and sue to labour for salary on February 2009. Now we facing problem is our company want to sue us run away without notice. What can we do? Are they sue us will be success? Can get back the salary and EPF? We will facing problem while they sue us with the reason of we run away withoutn notice?

If the employer sues you, you may defend yourself saying he failed to pay your salary, fail to contribute to EPF and that was the reasons why you left. Let the Labour Office decide when the case goes there.
