Need some advice, this is about staff qualification for OT claim. I'm a regional manager with salary more that 1500 but less that 5k. Our company has issue employee handbook for guidance, in that handbook it never stated that a certain qualification for a staff to claim OT. Hence it stated only the basis calculation for OT claim. Now my issue is, I've claim OT since last year and it was paid by the company. Now this year my OT claim has been rejected due to my designation status. After I've query this issue with HR, They produce 1 new handbook - Feb 2009 & with statem "Overtime means work done in excess of the normal hours of work and is only applicable to those below the managerial grade". Do I have the right to fight for my OT claim for the month of January 2009?

Since the new policy in the new handbook was effective only in Feb, they should pay your Jan OT as what had been done before. You have to talk to your HR yourself, the Labour Department may not help as you are not covered by the EA.

How we know that is we are covered by the EA?
What is the diferrece?
is under company contract not covered?
or we accept the company hand book/ confirmation letter with the
company own policy than we are not covered?
