Re: termination of staff

Our company wish to expelling a malay pregnant staff who having excessive absenteeism for the past 1 year. At least 1 day of Emergency Leave and 1 day of MC per day.

We are planning to give her 1 month notice and 2 months maternity leave salary…and off she goes.

can we terminate her with the reason of retrenchment? She joint our company since 23.4.2007. Is compensation needed?

Or you may advice the best solution as we had been giving her few times of consultation that the company dissatisfy with her attendance performance.

On top of those mentioned by you, you should also pay termination benefits at 10 days salary for every year of service which may come to about 18 to 19 days salary for 1 year 10 months service.

Apart from that, she has the right to complain to the Industrial Relations Department for wrongful dismissal. Consult the IR Department for further advice.
