Hi !

My staff has tender resignation on 12/2/09 with 1 mth notice. Her salary is rm 2500. Her balance annual leave till mid March 09 is 5 days. when is her last day ? If she ask for early dismiss by offseting the annual leave 5 days ; does she earn the leave as pay leave ?

Please advice.

Her notice should end on 11 March. She can apply for the 5 days leave balance before she goes. It is leave with pay.

Hi Mr Siew,

Thanks for prompt response.

As per your statement, her last day is 11 March and she is allowed to apply the 5 days, therefore her last day will be 3 March since 9 March is PH. We will be paying her till 11 March , Am i right ?

Mr Siew,

HR Mgr said the 5 days leave she earned is NOT PAY LEAVE and assume as normal leave application. therefore she is not entitle for the 5 days and shld be paid till 3 March only. Does this make sense ?

I am not sure if he is right about that. You may consult the Labour Department.
