Re: Hold salary after resignation notice

Im asking this question for on behalf of my coulege. Actually the resignation notice per contract in our company is 2 months. However the problem here is company are not paying the last 2 month salary after resignation notice given. Im not very sure whether they will not pay or hold with no reason. I give you and example: If we put the resignation notice sometimes mid December, they will hold the salary for end December, End January and balance 15 days in Feb eventhogh we have handover all the task and any company asset in proper manner. My question is what is the best solution employee should take in order to overcome this.

Advise your friend to complain to the Labour Department if the company fails to pay his salary. Meanwhile your friend should do his part by doing his work as usual and he should give a proper handover.

The Labour Department cannot take up such a case. It the case involves termination of service, you may complain to the Industrial Relations Department. If it involves non payment of salary or similar matters, you can engage a lawyer to sue in civil court. Any lawyer in a reputable law firm will do.
