My company staff book mention the Annual Leave as below :-

(i) Annual Leave entitlement for confirmed and full-time staff is as
Less than 1 year
-pro-rated based on his/her completed months of service in the calendar year.
1 to 5 years service -14 working days
6 years & above -17 working days

I have a scenario here:
Joint date : 12/2003

In year 2004, the annual leave entitlement is the pro-rata calculation for period from 12/2003 to 12/2004. So, it's 13 days.

In year 2005 to 2008, the annual leave entitlement for the service rendered from 1/1/2005 to 31/12/2008, which is 14 days per years.

i'm tendering my resign letter at 30/11/2009 and my last day of employment will be on 31/12/2009 (before deduction of the balance of annual leave).

So, the annual leave entitlement for the service rendered from 1/1/2009 to 31/12/2009 should be 14 days or 17 days?

Note : My company management inform me, i just entitlement for 14 days.

12/2003 to 12/2004 is more than one year, why prorated to 13 days?
Isn't 1/1/09 to 31/12/09 your 6th completed year? Why 14 days and not 17 days?

The management just explain, our company policy for the annual leave entitlement for the 17 days, the staffs service rendered must be work in full months in the six years and the 17 days annual leave just entitlement in the next year, in the year 2010. Same as the year i just joined this company, i just can entitled the 14 days annual leave in the 2nd year, in the year 2005.

What can i do? My management decision is final & i really not happy about the decision. Is it the calculation from my company is correct?

You can consult the Labour Department for another opinion.

My company pay us 8 days annual leave for the 1st year. I join in June 2010.How many days earn annual leave do i get from June 2011. My employer said i only get 4 days earn leave until end of the year.
