My company staff book mention the Annual Leave as below :-
(i) Annual Leave entitlement for confirmed and full-time staff is as
• Less than 1 year
-pro-rated based on his/her completed months of service in the calendar year.
• 1 to 5 years service -14 working days
• 6 years & above -17 working days
I have a scenario here:
Joint date : 12/2003
In year 2004, the annual leave entitlement is the pro-rata calculation for period from 12/2003 to 12/2004. So, it's 13 days.
In year 2005 to 2008, the annual leave entitlement for the service rendered from 1/1/2005 to 31/12/2008, which is 14 days per years.
i'm tendering my resign letter at 30/11/2009 and my last day of employment will be on 31/12/2009 (before deduction of the balance of annual leave).
So, the annual leave entitlement for the service rendered from 1/1/2009 to 31/12/2009 should be 14 days or 17 days?
Note : My company management inform me, i just entitlement for 14 days.
