Re: Replacement off days in in view of work on public holidays

Hi, I would like to check if the employer is allow to grant another day off to the staff should he works on a public holiday. For instance, we are in a retail environment and malls do not close on PH. My employees are work based on a 6 days roster per week and PH falls on a non -off day. Can i grant him a PH-in-lieu and not pay him any OT rates.

Under the Employment Act, there is no provision for replacement day-off for working on public holidays. It must be paid. However if the employee agrees, there may be no problem. Again for those whose salary is over RM1500 and not covered by the EA, then there is no law to prevent you from granting a day-off in lieu.
