I have signed a termination of employment letter at about 11:30 am this morning under duress. Is there a limitation period that allows for retraction of the same within 24 hours?

I don't think your employer will allow you to retract the letter of resignation. There is no such provision in the Employment Act for retraction.

Where is justice for the employee when things are done under duress? What are my options available now? Isnt there a law to protect employee under such circumstances under the Malaysian Labour law?

You may consult the Labour Department or the Industrial Relations Department.

I have a staff(technician) which is employed less than 1 yr, around 9 months. He's still under probational period, not a confirm staff yet, due to his under-performance, but without any warning letters issued whatsoever. The company decided to terminate him end of Dec2009, but will pay him extra compasionate salary until Jan2010, he has to work only until Dec2009. Unfortunately, the staff was not satisfied, he refused to write a resignation letter, he wants to report to labour department.

What can I do to resolve the matter, without complicated issue with the labour department?
