Referring to our employment contract, there is a retirement allowance and sometime they give to the employee who is resigning from the company calculate based on their year of service.

Q : Case 1
Staff with 2yrs service resigning on December 2004 received their bonus for that particular year when completes duty. But, another staff with 28yrs service and retired by the age of 60 on November 2004 did not get bonus, as she service from January - November 2004 before the retirement. The Employee mentioned that the staff did not complete 12mths service, and the bonus only be paid if staff still working on the 1st December 2009.

Q : Case 2
How to calculate a standard pro-rate bonus, if we normally received 1month annually bonus (depending on loss/profit of the company)? The staff wages is RM1600/-.

I dont have any qualification on HR matter. Just assisting the Manager on HR, but since the employees always referring to me. Please clarify and advice me what should I do. ty.

I don't think I can give any advice. If you are not sure, I suggest you consult your HR manager. He should be able to tell you how to calculate.

Bonus is not compulsory and based on company discretion..is it true?

Employment contract stated only retirement allowance + total of number of days working but did not mentioned about bonus. I only can advise the staff to refer to HR manager, but if not satisfied can she go to the labour Dept and refer?

If you are the one assisting the HR manager, you yourself should understand fully how the system works. If you are not sure, ask the HR manager for guidance. Only then you can give proper advice to the staff who approaches you.

The employer is foreign company. HR system if fully handled by the Officer (Foreigner). They just follow the system based on our labour law and employment act. (which been practiced before since 1970's
-every 3 years the officer will change)

On my own survey, refer to the Bonus issue given is based on the Company discretion. I do advise my colleagues to refer directly to the officer, if they want to know how is the calculation made (staff wages/bonus) and if they entitled or not entitled to this benefits.

Please advise or any suggestion on how to communicate with my colleagues for them to deal directly with the Officer...?

If you are really not sure what is going on, then you have to ask your colleagues to deal directly with that officer. I suggest you yourself do the same.
