Re: basic salary include allowance?

my basic salary now is RM1180, and allowance RM200. Total RM1380.
now my HR consider increace my basic salary to RM1300, remain the allowance to RM200. totall RM1500.
according to HR, start next month my pay is RM1500. so i am not protected under the employment act. i cannot claim any OT and i have to work on sunday, and it will not entitle to claim also.
is taht basic pay include allowance and reach RM1500 is not cover by the employment act?

Yes, it includes allowance but the First Schedule says ".... such personís wages do not exceed one thousand five hundred ringgit a month. ..". So, since your total salary does not exceed RM1500 and therefore you are still covered by the Employment Act.
Don't tell your HR about this. Keep proper records of the overtime you worked, the Sundays you worked because you might one day want to make claims against the company at the Labour Department.

i am not a manual labour worker. is admin clerk. i am entitle to one day off in the week day, but work on Sunday. currently i am working on sunday and entitle to the Sunday
claim +0.5% of my daily basic. start next month no more. i have spoke to my manager. i do not mind if i cannot claim OT during the week days. but i just request the Sunday claim. He wants me to prove him any Act or or law. how and what should i prove to him?
i am working for 8 years, beginning of the 2 years i request for the comfirmation letter or the employment contract. but my manager said no need. Can i ask him to replace for me now?

No need to ask for one. 8 years of service is enough to say or to prove that you are confirmed.

Im receiving RM 1,300 + 500.00, basic and allowance respectively. My total salary is RM 1,800.00 , u mean im no longer cover by the EA?
