Re: AL calculation - Resignation w/o notice


If an employee resign w/o giving any notice, how will be the AL calculation like?

Example, he tendered on 30/9/09, last working day should b 29/10/09. But he would like to compensate company for the short notice of 1 month & leave on 30/9/09. So his AL calculation should be pro-rated till end of Sept or end of Oct 09?

Please advice.

Since the section in the Employment Act pertaining to annual leave made no mention about this, I would say it should be end of September. It is only mentioned in the sections pertaining to maternity benefits. For calculation of eligible period to qualify for maternity allowance, it would then be end of October. .Cross check with the Labour Department.
