If staff are required to work on Saturday, Rest Day or Public Holidays, if the Company not afford to pay overtime, can the company replace it / give to staff with annual leave? Please advise.

In the first place, if the company cannot make enough profit to pay for overtime, then I think the company should not ask the employees to work overtime at all.

About your question, the Employment Act makes no mention about replacement for those matters. They must be paid accordingly. However, if the employees concerned agreed with the practice and made no complaint then there would be no problem.

IF WE WORK 1 DAY 12 HOUR, THEY SHOULD GIVE US OT 2 HOUR RITE?

Is it possible for the employer to only allow OT claim of 2 hrs or 4 hrs. For example, if the we work for extra 1 hr, we cant claim any pay and if we work for extra 3 hrs, only 2 hrs of OT pay will be given. They even specify this in the employment contract. Is this unlawful?

Mr Siew, we would like to know more above mentioned scenario. Is it 2 hours OT or 4 hour OT if the staff working schedule is 5 days works, 2 days offday and 12 hours work per day?
