may i know how many no pay leave for the following staff

1) 1/9/09 to 11/9/09 (working days - Mon to friday) r
- can i deduct 11 days or 9 days (excluding sat and sun)

which one is correct ?

2) 18/9/09 to 26/9/09 (this staff working days - (Mon to sat)
- 9 days no pay or 6 days (excluding two days publc holiday and 1 sun)

No-pay leave is not mentioned or defined anywhere in the Employment Act and it is not a right of the employee to have no-pay leave. No-pay leave has to be applied for from the employer for certain legitimate purposes and subject to approval of the employer. In order to avoid dispute or any ambiguity, I would suggest you have no-pay leave defined in the company policy or handbook. You may say no-pay leave can be applied for purposes like going for preparation of examination, attending education courses, attending to sick members of family and so on. You also can say any no-payment longer than a continuous period of half a month shall include all rest days, public holidays, sick leave and so on.

In your case, I don't know what meant by no-pay leave. Was it just absence? Anywhere, in my opinion if the period is less than half month, it should not include rest days and holidays. But just bear in mind. no-pay leave is not a right and in fact should be discouraged.
